About the Centre:
Dispute is an unavoidable element of human society. Disputes, if not resolved effectively at its early stage, lands in a court and then ordeal of both the litigants begins. Indian courts are overburdened with millions of pending cases and are incapable to deal with pending cases promptly and efficiently. Though fast track courts and tribunals are being established, number of pending cases is huge and the rate of filing of new cases is tremendous. Baring few exceptions, courts of almost all the countries are facing similar problems. In this situation, the litigants must adopt alternative dispute resolution methods. Lack of knowledge and unavailability of easy to reach institutions to resolve disputes amicably is one of the reasons that litigants go to the courts despite its inefficiency in resolving it speedily and effectively.
Keeping this in mind, Centre for Alternative Dispute Resolution (CADR) proposes facilitating dispute resolution. The centre proposes to encourage disputants to use alternative dispute resolution methods and aims to provide assistance in resolving their dispute.
Mediation and arbitration are the popular methods of dispute resolution. CADR proposes to get a sanction from the State Legal Services Authority and have an association with District Legal Services Authority to resolve the cases by mediation.
At its initial stage, Centre for Alternative Dispute Resolution (CADR) intends to provide assistance for conducting ad-hoc arbitration. Parties, who wish to resolve their dispute with the help of arbitration, will be guided accordingly and necessary arrangements will be made to support for effective resolution of their dispute.
CADR is also determined to conduct research in the field of ADR to assist the state authorities to frame policies. Centre also aims to provide training to stake holder, spread awareness and conduct the various certificate courses in the field of alternative dispute resolution.
